In a case filed by the Software Freedom Conservancy the US District Court for the Southern District of New York issued an default judgment upholding the validity of the Busybox GPL license and ordering Westinghouse Digital to pay triple damages for copyright infringement and to cease distribution of the offending product. According to the Software Freedom Conservancy, this order of default judgment marks the first time a court in the USA has granted an injunction ordering a GPL violator to permanently cease distribution of out-of-compliance GPL'd software. As always, there is more to the story – as reported in the Register , but it still represents a wake-up call for organizations using open source software in commercial applications.
